Terms and Conditions for Consultation Booking
1. Acceptance of Terms
By booking a consultation through our Telemedicine/ Telehealth platform, you agree to be bound by these Terms and Conditions.
2. Cancellation Policy
2.1 Cancellations must be made at least 24 hours before the scheduled appointment time.
2.2 If a cancellation is made less than 24 hours prior to the appointment, or in the event of a no-show, you will be charged the full fee for the consultation.
3. No-Show Policy
3.1 Failure to attend a scheduled appointment without prior notification will be considered a no-show.
3.2 In the case of a no-show, the full fee for the consultation will be charged.
4. Payment
4.1 Payment for the consultation is required at the time of booking.
4.2 In the event of a late cancellation or no-show, the fee charged will not be refunded.
5. Rescheduling
5.1 Appointments can be rescheduled up to 24 hours before the scheduled time without any additional charges.
5.2 Attempts to reschedule within 24 hours of the appointment time will be subject to the full consultation fee.
6. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Your continued use of our services following any such modification constitutes your acceptance of the new Terms and Conditions.

These Terms of Use ("Terms") govern access and/or use by individuals who have registered with TelmyVet and have a Pet/Animal Owner Account or Provider Account, or a profile in a Pet/Animal Owner Account or Provider Account ("you," "your," "User(s)"). This applies to applications, sites, websites, content, products, and services (collectively referred to as the "TelmyVet Platform"), owned and operated by TelmyVet Inc. ("TelmyVet," "we," "us").
These Terms of Use apply to Pet/Animal Owners and Healthcare/Veterinary/RVT care Providers, governing their use of online interfaces and properties (e.g., websites and mobile applications) owned and controlled by TelmyVet, including the https://TelmyVet.com website (the "Site") and the services available through the Site ("Services"). The terms "Pet/Animal Owner," "Provider," "You," "your," and similar terms refer to those who access or use the Site and/or Services. Compliance with these Terms of Use is a condition of your use of the Site and/or Services.
USER DEFINITIONS
Pet/Animal Owner: A client, individual or entity invited by a Provider to use the Services on the TelmyVet Platform. This includes all Pet/Animal owners and other applicable users.
Provider: Healthcare, Veterinary, or Registered Veterinary Technicians (RVTs) who offer services through the TelmyVet Platform.

BY ACCEPTING THESE TERMS OR BY ACCESSING THE SITE OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS OF USE, INCLUDING THE PRIVACY POLICY REFERENCED BELOW. IF YOU ARE NOT ELIGIBLE OR DO NOT AGREE TO THE TERMS OF USE, THEN YOU DO NOT HAVE PERMISSION TO ACCESS THE SITE OR USE THE SERVICES.

THE HEALTHCARE PROVIDER WILL DETERMINE WHETHER OR NOT THE CONDITION BEING DIAGNOSED AND/OR TREATED IS APPROPRIATE FOR A TELEMEDICINE/TELEHEALTH ENCOUNTER VIA THE SERVICE.
PRIVACY POLICY
Please review the TelmyVet Privacy Policy. It contains a description of our privacy practices and policies, including how we collect and handle your information. It is incorporated into and is a part of these Terms of Use. By using the Site or Services, you accept the Privacy Policy.
For clarity, these Terms outline the conditions under which you may utilize the TelmyVet Platform on behalf of another entity, specifically your Pet/Animal. In instances where you are doing so (as permitted), references to "you" and "your" in these Terms also encompass your Pet or any other animal registered under your account for which you have the legal responsibility to seek Veterinary Services (each referred to as a "Registered Pet/Animal").
SECTION 1 - TELMYVET TELEVETERINARY PLATFORM (TELMYVET)
The TelmyVet Platform is a technology platform that connects Pet/Animal Owners with Veterinarians/RVTS for the provision of virtual veterinary care and related services. TelmyVet acts as a facilitator in connecting Pet/Animal Owners and Veterinarians/RVTS, but it is not a party to the relationship between the Pet/Animal Owner and the Veterinarian/RVTS. Veterinarians/RVTS are independent professionals and are not employed or affiliated with TelmyVet.
Veterinarians/RVTS on the Site, referred to as "Providers," must agree to comply with all applicable laws, regulations, and professional standards governing their practice. The relationship between Providers and TelmyVet users, including Pet/Animal Owners, is solely between the Provider and the Pet/Animal Owner. TelmyVet does not establish a veterinarian-Pet/Animal Owner relationship with the Pet/Animal Owners.
TelmyVet does not practice veterinary medicine or provide any licensed professional services. Providers are solely responsible for all agreements, consents, notices, and interactions with Pet/Animal Owners and other users. This includes handling billing and collections from Pet/Animal Owners, for which TelmyVet has no liability.
If you use our Site to provide services to Pet/Animal Owners, you are considered a "Provider." You agree to provide services in compliance with all applicable laws and regulations. TelmyVet does not provide services directly to Pet/Animal Owners or any other individuals apart from the Providers.
All veterinarians offering veterinary care Services or Informational Services (referred to as "Veterinary Care Providers") on the TelmyVet Platform are independent professionals registered to practice veterinary medicine in their respective jurisdictions. TelmyVet is not a healthcare provider. Veterinary Care Providers are solely responsible for the Services and Informational Services they provide through the TelmyVet Platform.
Depending on the laws of your jurisdiction, the Veterinary Care Provider may be located within your jurisdiction or in another jurisdiction. If you need information about a specific Veterinary Care Provider, you can consult their profile on the website of the relevant veterinary regulatory body, such as the College of Veterinarians in your province or territory.
INDEMNIFICATION
You agree to hold harmless and indemnify TelmyVet, its related or affiliated companies, and their directors, officers, agents, representatives, employees, volunteers, independent contractors, subcontractors, sponsors, successors, and assigns from any liability for any damage, loss, expense, or injury to any third party resulting from your use of the TelmyVet Platform.
INDEPENDENT PROFESSIONAL JUDGMENT AND INDEMNIFICATION
In no event shall TelmyVet or its affiliates be liable for any damages (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising from the use or inability to use the TelmyVet Platform, even if TelmyVet has been advised of the possibility of such damages. It is hereby further expressly agreed and declared that TelmyVet shall not be liable for any claims or damages, including those resulting from or caused by (i) Pet/Animal Owner/provider fault, negligence, or failure to perform provider/Pet/Animal Owner responsibility; (ii) claims against Pet/Animal Owner/provider by any other party; (iii) any act or omission of any other party. Each consenting party (provider/Pet/Animal parent/ Pet/Animal Owner) shall be liable hereunder only for its own gross negligence, willful misconduct, or bad faith. In the event of any litigation arising from or related to this Agreement, or the services provided under this Agreement.
The Provider will use the Site and Services following applicable standards of good professional practice. While software products such as the Site and Services can facilitate and improve the quality of service that Provider and its personnel offer to Pet/Animal Owners, many factors, including the provider/Pet/Animal Owner relationship, can affect a Pet/Animal Owner outcome, and with intricate and interdependent technologies and complex decision-making, it is often difficult or impossible to accurately determine what the factors were and in what proportion they affected an outcome. Provider shall be solely responsible for its use of the Site and Services and the provision of services to Provider's Pet/Animal Owners. In this regard, Provider releases TelmyVet and waives all potential claims against TelmyVet as a result of the Provider's use of the Site and Services and the provision of services to Provider's Pet/Animal Owners.
As a result of the complexities and uncertainties inherent in the Pet/Animal Owner care process, Provider agrees to defend, indemnify, and hold TelmyVet harmless from any claim by or on behalf of any Pet/Animal Owner of Provider or its personnel, or by or on behalf of any other third party or person claiming damage by a familial or financial relationship with such a Pet/Animal Owner, which is brought against TelmyVet, regardless of the cause if such claim arises for any reason whatsoever, out of the use or operation of the Site and Services. To the extent applicable, the Provider will obtain TelmyVet's prior written consent to any settlement or judgment in which the Provider agrees to or which otherwise provides or implies any finding of fault of TelmyVet or any defect in the Site or Services. TelmyVet will promptly notify Provider in writing of any claim subject to this indemnification, promptly provide Provider with the information reasonably required for the defense of the same, and grant to Provider exclusive control over their defense at Provider's expense.
TelmyVet reserves the right to appear and defend any actions in which it is named as a party. The provider agrees to pay and reimburse TelmyVet's costs and expenses (including reasonable attorney's fees) incurred in connection with such a suit. If you, your Pet/Animal Owners, or any third party seek to recover any sums from TelmyVet arising from your use of TelmyVet or treatment you provide to a Pet/Animal Owner while using TelmyVet, you will be solely responsible for and required to pay any such sums.
LIMITATION OF LIABILITY (TELMYVET):
You acknowledge and agree that TelmyVet Inc, its affiliates, and each of their directors, officers, employees, agents, representatives, licensors, successors, and assigns (collectively, the "TelmyVet Group") shall not be liable to you for any damages or losses arising from your use of or inability to use the mobile responsive web application or the services provided. Your only recourse in case of any problems or dissatisfaction with the application or services is to cease using the application and services.
The TelmyVet Group shall not be liable to you for:
- Indirect, special, incidental, exemplary, punitive, or consequential damages.
- Loss of income, business, actual or anticipated profits, opportunity, goodwill, or reputation (whether direct or indirect).
- Injury or death of any Pet/Animal or person.
- Delay or failure in performance of the services due to causes beyond TelmyVet's reasonable control.
- Loss, damage to, or corruption of data (whether direct or indirect).
- Claims, damages, or losses arising from or relating to your use of the services.
- Claims, damages, or losses arising from or relating to virtual veterinary care, pharmaceutical services, informational services, transactions, or relationships with veterinarians or other authorized providers.
- Claims, damages, or losses arising from third-party products, services, technologies, or platforms.
To the fullest extent permitted by applicable law, TelmyVet's liability, and the liability of any member of the TelmyVet Group, to you or any third party, is limited to the greater of (a) the amount of fees you have paid to TelmyVet in the twelve months prior to the action giving rise to liability, or (b) CAD$100.00 in total for all claims.
Please note that some jurisdictions, including Quebec, do not allow the limitations of damages and exclusions of liability for personal injury or death, incidental, consequential, or similar damages. Therefore, some of the above limitations may not apply to you.
SERVICES
TelmyVet is an online platform that connects Pet/Animal Owners with veterinarians for virtual veterinary care services for their Pet/Animals. TelmyVet allows Pet/Animal Owners to consult with veterinarians through text, audio, and video technology. Veterinarians may provide medical advice, diagnose conditions, and recommend treatments based on the information provided by Pet/Animal Owners. However, please note that TelmyVet does not provide veterinary services directly.
TelmyVet may also offer the option for veterinarians, where permitted by law, to prescribe medications deemed medically appropriate for the Pet/Animal's condition. In such cases, Pet/Animal Owners may choose to use TelmyVet's online pharmacy service, subject to the terms and conditions of the pharmacy provider.
It is important to understand that TelmyVet acts as a technology service provider and does not employ or credential the veterinarians available on the platform. Each veterinarian is an independent licensed practitioner responsible for the care provided to Pet/Animals and obtaining Pet/Animal Owner consent for any veterinary treatment.
TelmyVet is not involved in the agreements or transactions between users of the platform. The quality, safety, legality, and accuracy of the virtual veterinary care services, including any advertisements or reviews, are the sole responsibility of each user. Users are responsible for complying with all applicable laws, rules, and regulations related to their use of the TelmyVet platform.
While TelmyVet may provide access to general veterinary information, it is important to note that the content on the platform should not be considered as a substitute for individual veterinary advice, diagnosis, or treatment. Pet/Animal Owners should always consult with a licensed veterinarian or regulated veterinary professional for personalized advice regarding their Pet/Animal's health. TelmyVet does not guarantee the safety, appropriateness, or effectiveness of any drug or treatment for a Pet/Animal.
TelmyVet takes measures to address potentially fraudulent or illegal activities but assumes no liability for such activities. While we strive to provide warnings or messages to users regarding such activities, we cannot guarantee the accuracy, reach, or effectiveness of these messages.
It is essential to contact a licensed veterinarian promptly if you suspect your Pet/Animal has a medical problem or condition, either through TelmyVet's services or other means. Veterinary advice should never be disregarded, avoided, or delayed based on information obtained from the TelmyVet platform.
ACCOUNT & IDENTITY VERIFICATION
To access certain features or services on the TelmyVet platform, you are required to create an account. During the registration process, you will be asked to provide accurate and complete information. It is your responsibility to keep your account information up to date by notifying us of any changes. All personal information associated with your account is managed by our Privacy Policy.
Your access to and use of the TelmyVet platform is for your personal use only and is non-transferable. You are solely responsible for maintaining the confidentiality of your user ID and password, and for any activities that occur under your account. You must not use another user's account without their permission. If you suspect any unauthorized use of your account or any breach of security, you must immediately notify TelmyVet and take necessary actions to secure your account.
TelmyVet and its affiliates cannot be held liable for any loss or damage arising from your failure to comply with the above requirements. You acknowledge and agree that neither TelmyVet nor any member of the TelmyVet Group will be responsible for any unauthorized transactions made using your user ID or password. Unauthorized use of your account could result in liability to both TelmyVet and other users.
Please note that verifying the identity of users on the internet is challenging, and TelmyVet does not assume any responsibility for confirming each user's identity. While we provide communication tools on the platform, it does not guarantee the identity of the individuals you interact with. We encourage you to take reasonable measures to verify the identity of other users.
We reserve the right to deny your access to the services or any part thereof if we believe it is necessary to maintain security or performance, or if we suspect a breach of these Terms or unauthorized account usage. Each Provider is allowed to have only one account, and we may suspend an account for investigation if we suspect a violation of these Terms. Additionally, we may suspend or cancel a veterinarian's listing or a Pet/Animal Owner's account if we suspect unauthorized or fraudulent activities. In cases where proof of identification is requested and not provided within the specified time, we reserve the right to cancel associated transactions at our discretion.
INTELLECTUAL PROPERTY
The TelmyVet platform, including all associated software, algorithms, protocols, interfaces, and intellectual property related to the services (such as copyrights, inventions, patents, trademarks, trade secrets, and industrial designs), are either owned or licensed by TelmyVet. These Terms do not grant you any ownership rights or interests in the services or associated intellectual property.
The trademarks "TelmyVet," "http://www.TelmyVet.com," "http://www.TelmyVet.ca," and "http://api.www.TelmyVet.com" "http://app.TelmyVet.com" "http://demosite.TelmyVet.com" “http://www.TelmyVet.com/meeting” are owned by TelmyVet.
The names and logos of other companies' services appearing on the platform are trademarks of their respective owners. These Terms do not grant you any rights or interests in these marks. Unauthorized use of our trademarks and trade dress is strictly prohibited without our express written consent.
We respect the intellectual property rights of others, and we do not tolerate any posting of content on the platform that infringes upon someone's intellectual property, including copyrights. If a user repeatedly infringes upon copyright, we may terminate their account. If you become aware of or suspect any copyright infringement on the TelmyVet platform, please notify us immediately using the contact information provided under the "Contact Us" section.
INTERNATIONAL USE
TelmyVet acknowledges that the information and services provided on the platform may not be applicable to, suitable for, or accessible in locations outside of Canada. If you decide to access the platform from a location outside Canada, you do so at your initiative and you are responsible for complying with the local laws and regulations of that jurisdiction.
VIRTUAL WAITING ROOM/CONSULTATION ROOM
The TelmyVet platform includes a Virtual Waiting Room and Consultation Room as part of its services. Like a physical waiting room, the Virtual Waiting Room/Consultation Room allows anyone to enter. Consequently, any content you post in your Virtual Waiting Room/Consultation Room can be viewed by anyone who enters. The platform also allows you to post content and links to other sites within the Virtual Waiting Room/Consultation Room. You retain full ownership and responsibility for the content you post and the links you share, as long as they do not violate the Terms of Use. TelmyVet does not claim any rights or interests in the content you post. By posting content and links, you agree to be solely responsible for them and to indemnify and hold TelmyVet harmless.
RESPONSIBILITY FOR VETERINARY LISTINGS, REVIEWS AND OTHER USER-CONTRIBUTED CONTENT
TelmyVet has no obligation to pre-screen user-contributed content posted on the site, including veterinary listings, reviews, and participation in interactive forums. TelmyVet is not responsible for such user-contributed content. However, TelmyVet reserves the right, at its sole discretion, to decline or remove any user-contributed content that fails to meet content requirements or violates the Terms of Use or other guidelines. TelmyVet may also remove user-contributed content if it receives notice of a breach of the Terms or requirements regarding such content.
User-contributed content must be directly related to the site, business service, product, or forum, and should not infringe upon anyone's rights, violate the law, including personal information of others, contain unsolicited promotional content, be obscene, abusive, discriminatory, illegal, false, or misleading.
All veterinary listings on the site are the sole responsibility of the vet, and TelmyVet disclaims liability for inaccuracies in listings, reviews, or breaches of contract. Vets are responsible for maintaining up-to-date listings, including practice representations, services, office locations, and prices. TelmyVet does not guarantee the accuracy or currency of listing content, veterinarian qualifications, reviews, or pricing information.
TelmyVet may change location or geographic descriptions associated with listings without notice, and vets are responsible for ensuring the accuracy of location information. Pet/Animal Owners are responsible for verifying the accuracy of content and descriptions.
User-contributed content, other than veterinary listings, is the sole responsibility of the user who contributed it. TelmyVet disclaims all liability for user-contributed content and may request proof of ownership or permission before posting such content.
By submitting or authorizing user-contributed content, you grant TelmyVet and its affiliates a perpetual, worldwide, non-exclusive, royalty-free license to use, copy, adapt, distribute, display, reproduce, transmit, modify, and exploit the content in connection with their business. TelmyVet may register copyrights to protect user-contributed content and may sublicense these rights to third parties for promotional or other services.
If you retain moral rights in user-contributed content, you waive those rights and agree to the publication, use, modification, deletion, or exploitation of the content by TelmyVet or its affiliates. You also agree to assist TelmyVet in protecting copyrighted material from unauthorized use.
INFORMED CONSENT FOR VIRTUAL VETERINARY CARE:
By engaging in virtual veterinary care services provided by TelmyVet, you acknowledge and agree to the following:
Privacy and Confidentiality: You understand that the laws protecting privacy and confidentiality of medical information also apply to virtual veterinary care. Your personal and Pet/Animal's medical information may be electronically communicated to veterinary practitioners who may be located in other areas, including those outside your country or region.
Anticipated Benefits and No Guaranteed Results: While you may expect benefits from using virtual veterinary care, such as convenient access to veterinary expertise, no specific results can be guaranteed or assured.
Medical Record: All information discussed or provided during the virtual veterinary care session will become part of your Pet/Animal's medical record. The same restrictions on dissemination and confidentiality will apply to this information.
Responsibility of Veterinary Providers: Authorized veterinary healthcare providers are solely responsible for the veterinary services and informational services they provide to you. This includes compliance with standards of care, record-keeping, and other professional obligations.
Provider Discretion: Just like any other veterinary consultation, your veterinary provider may determine that virtual veterinary care is not appropriate for some or all of your Pet/Animal's treatment needs. They may elect not to provide virtual veterinary care to you through the TelmyVet platform.
Providing Information: You are responsible for providing your veterinary provider with the information they advise is necessary to provide appropriate veterinary care and services.
Withdrawal of Consent: You have the right to withdraw your consent at any time by contacting TelmyVet and requesting the deactivation of your account.
Sharing of Healthcare Information: Your Pet/Animal's healthcare information may be shared by your veterinary provider in certain circumstances, such as when required by a valid court order, for reporting suspected abuse or neglect, or to prevent or reduce a serious threat to anyone's health or safety.
By proceeding with virtual veterinary care, you acknowledge that you have read and understood the above information and consent to the use of virtual veterinary care services for your Pet/Animal.
HOW IT WORKS WITH TELMYVET
Create an Account: Start by creating an account on the TelmyVet platform. Provide the necessary information and create your profile.
Select a Veterinarian: Once you have an account, you can search for veterinarians available on the practice website.
Schedule an Appointment: After selecting a veterinarian, you can schedule an online virtual appointment. Choose a convenient date and time for the consultation.
Virtual Waiting Room: Before the scheduled appointment, you will enter the virtual waiting room. This waiting room is like a physical waiting room in a veterinary clinic. You may have to wait until the veterinarian is available to start the consultation.
Consultation: Once the veterinarian is ready, you will enter a virtual consultation room. Here, you can communicate with the veterinarian through video chat and discuss your Pet/Animal's health concerns.
Receive Advice and Recommendations: During the consultation, the veterinarian will assess your Pet/Animal's condition, provide advice, and recommend necessary treatments or actions. They may also prescribe medications if needed.
Follow-up and Additional Services: Depending on your Pet/Animal's needs, the veterinarian may recommend follow-up consultations or additional services. You can schedule further appointments as required.
It's important to note that the specific steps and features may vary depending on the TelmyVet platform's functionality and updates. It's always recommended to familiarize yourself with the platform and its terms of use for a seamless experience.
DISCLOSING INFORMATION
As a courtesy and in accordance with our commitment to Pet/Animal Owner privacy and data protection, your contact information may be disclosed to the Office Manager at the veterinary practice designated to follow up with TelmyVet Pet/Animal Owners. This disclosure is limited to contact information necessary for coordinating post-consultation care and will be restricted to the Office Manager at the veterinary practice nearest to the address provided by you during your virtual visit with TelmyVet. The Office Manager's role includes initiating follow-up communication with you to facilitate any subsequent care recommended during your TelmyVet session. Additionally, the Office Manager may assist in arranging routine veterinary care or other services not specifically addressed during your session with TelmyVet.
Please be advised that this arrangement is subject to your consent. If you do not consent to the sharing of your contact information with the Office Manager for these purposes, it is your responsibility to promptly notify the relevant veterinary practice directly. Failure to provide such notification will be construed as your acceptance of these terms. It is our utmost priority to respect and uphold the confidentiality and privacy of our Pet/Animal Owners' information in accordance with applicable laws and professional standards.
Upon choosing to use TelmyVet to receive virtual veterinary care for your Pet/Animals, you accept sole responsibility for obtaining the follow-up care recommended by the veterinary professional(s) during your TelmyVet session. The follow-up call and assistance provided by the Office Manager should not be viewed as an assumption of responsibility by the veterinary practice to connect or provide you with follow-up care. These services are offered as a courtesy, and you retain responsibility for obtaining follow-up care.
WEBSITE CONTENT
Other than information received directly by you from veterinarians in the context of a TelmyVet session, the content on the TelmyVet website or Virtual Waiting Room/Consultation Room should not be considered veterinary advice. TelmyVet may post or provide links to general information resources that may be of interest to you ("Posted Materials"). Payment for services rendered by TelmyVet is to be made by credit or debit card. Payments are processed by a third party, Stripe Payments Canada, Ltd., which is certified in accordance with PCI Level 1 requirements. Therefore, TelmyVet has no access to your payment information, nor do we store such information. To ensure validity and accuracy, we may request updated payment information from time to time. Failure to meet the payment obligations may result in the suspension or termination of your account, as described below.
PAYMENTS
By using TelmyVet, you agree to pay the fees for the services you purchase, and you authorize TelmyVet to charge your debit or credit card or process other means of payment for those fees. TelmyVet works with trusted payment processing partners to offer you convenient payment methods while keeping your payment information secure. When making a purchase, you agree not to use invalid or unauthorized payment methods. If your payment method fails and access to the services is granted, you agree to pay TelmyVet the corresponding fees within thirty (30) days of notification. We reserve the right to disable access to the platform for accounts that have not received adequate payment.
For Providers: (Practice Owners)
By default, your TelmyVet monthly subscription will automatically renew, and the applicable membership fee will be automatically charged to you at the time of renewal using the active credit card on file in your account. We will provide prior notice to the extent required by applicable law. If you do not want your membership to be automatically renewed or if you would like to change your payment method, please make the necessary changes in your Account Settings.
From time to time, TelmyVet may offer trial or other promotional subscriptions to veterinary professionals. Such trial or promotional subscriptions are subject to the terms and conditions of TelmyVet, except as otherwise stated in the promotional offer, and are typically available for new providers.
If you receive free access or a trial or evaluation subscription (a "Trial Subscription"), you may use the TelmyVet platform by the terms and conditions of the agreement. Trial Subscriptions are intended for your use to determine whether to purchase a full subscription to TelmyVet. They are not to be used for any other purpose, including competitive analysis. At the end of the Trial Period, the Trial Subscription will expire, and you will have the option to purchase a full subscription to TelmyVet. If you choose to purchase a full subscription, all the terms and conditions in the agreement will apply, unless otherwise specified for the Trial Subscription.
TelmyVet will charge you the applicable fee after your free trial period has expired to the credit card on file with their third-party payment processing partners. If you cancel the subscription before the trial period has expired, TelmyVet will not charge you. TelmyVet may change the monthly or annual fee charged for subscriptions at any time, but any fee changes will not apply to current subscriptions until your current subscription expires and is renewed for another term.
For Pet/Animal Owners (Pet/Animal Owners):
When booking an appointment, a pre-authorization charge will be placed on your credit card. The final charges for your virtual veterinary visit will be applied immediately upon completion of the appointment. The cost of your visit will be determined by your veterinary professional.
DELIVERY OF E-PRESCRIPTIONS
For Providers:
TelmyVet does not operate as a pharmacy and does not provide referrals or recommendations regarding the e-prescription filling or refilling system. Veterinarians bear full responsibility for selecting and recommending pharmacies for the dispensing of prescriptions, including over-the-counter and prescription medications for their Pet/Animal Owners. TelmyVet does not provide any warranties concerning the quality of prescription drug products or the services offered by pharmacies. If you encounter any issues with the processing of e-prescriptions, you should advise the Pet/Animal owner to contact the pharmacy directly. It is important to note that TelmyVet does not offer veterinary medical advice, diagnosis, or treatment.
For Pet/Animal Owners (Pet/Animal Owners):
TelmyVet does not function as a pharmacy and does not make referrals or recommendations regarding the e-prescription filling or refilling system for Pet/Animal medications. Veterinarians are solely responsible for selecting, recommending, and providing pharmacy-related information for both over-the-counter and prescription medications for your Pet/Animals. TelmyVet does not provide any warranties regarding the quality of prescription drug products or the services offered by pharmacies. If you experience any issues with the processing of your Pet/Animal's e-prescription, you should contact your veterinarian or the pharmacy directly. It is important to note that TelmyVet does not offer veterinary medical advice, diagnosis, or treatment. We encourage you to consult with your veterinarian or a qualified veterinary pharmacist for any concerns regarding your Pet/Animal's health.
ADDITIONAL TERMS FOR MOBILE RESPONSIVE WEB APPLICATION (TELMYVET):
(a) Parties & Third-Party Beneficiaries: These Terms are solely between you and TelmyVet and do not confer any rights or remedies upon any person or entity other than you. TelmyVet is solely responsible for the mobile responsive web application, including all services provided through it.
If you access the mobile responsive web application via a third-party platform or app store, the terms and conditions of that platform or app store also apply. TelmyVet acknowledges that these third-party platforms or app stores have no obligation to provide maintenance and support services for the mobile responsive web application. Any claim arising from or related to your use of the mobile responsive web application is not the responsibility of the third-party platform or app store.
(b) Mobile Network: When you access the mobile responsive web application through a mobile network, you are responsible for any messaging, data, and other charges imposed by your network provider. Your network provider's terms and conditions may prohibit or restrict the use of the mobile responsive web application on their network.
(c) Software Updates: TelmyVet reserves the right to provide updates, new versions, and revisions, and make changes, corrections, and/or improvements (collectively "Updates") to the mobile responsive web application. By accessing and using the mobile responsive web application, you agree to receive automatic software Updates, including any files delivered to you by TelmyVet to patch, update, or modify the application.
DISPUTES; ARBITRATION (TELMYVET):
TelmyVet is committed to customer satisfaction, and in case you have any problems or disputes, we will make every effort to resolve your concerns. You agree to provide us with an opportunity to address any disputes or claims ("Claims") relating to the mobile responsive web application, our services, these Terms, interactions with our customer support team, any services or products provided, any representations made by us, or our Privacy Policy by contacting us as described below under the "Contact Us" section.
If there is a dispute between users of the application or between users and any third parties, you understand and agree that TelmyVet is not obligated to intervene. However, if TelmyVet chooses to get involved, our decision on the dispute will be final and binding.
(Not applicable to residents of Quebec, Canada) To the fullest extent permitted by applicable law, any proceedings to resolve Claims will be conducted solely on an individual basis and not as a class, consolidated, or representative action. To the fullest extent permitted by applicable law, any dispute, controversy, or Claims arising from or relating to these Terms and the agreement to arbitrate, including any questions regarding their existence, interpretation, enforcement, validity, applicability, breach, or termination, or the relationship established by these Terms, shall be submitted to final and binding arbitration, with no right of appeal. The arbitration will take place in Vancouver, British Columbia, and will be conducted in English. The arbitration will be presided over by a single arbitrator agreed upon by all parties or, if no agreement is reached, appointed by the International Centre for Dispute Resolution, solely acting as the appointing authority. The fees of the appointing authority will be initially paid by TelmyVet but may be reimbursed to TelmyVet by the arbitrator in the award. The parties involved in the arbitration will share equally the costs of the arbitrator, and each party will bear its own costs incurred in preparing and presenting its case during the arbitration, subject to the arbitrator allocating all or part of such costs to the prevailing party in the award. If you demonstrate that you cannot afford to pay the arbitrator's fees, the arbitrator may require TelmyVet to initially cover the fees, but these may be reimbursed to TelmyVet by the arbitrator in the award. Except as required by law, neither party nor its representatives may disclose the existence, content, or results of any arbitration conducted under these Terms without the prior written consent of the parties.
If, for any reason, a dispute, controversy, or Claim proceeds in court instead of arbitration, we both waive any right to a jury trial to the extent permitted by applicable law.
GENERAL PROVISIONS (TELMYVET):
Notices: Any notices or communications to TelmyVet under these Terms must be in writing and delivered either by email or by internationally recognized courier service to the contact information provided below under the "Contact Us" section. By contacting us or registering for an account, you consent to receive electronic communications from us regarding your account and your use of the mobile responsive web application. You agree that such electronic communication constitutes legal written communication in compliance with any applicable legal notice requirements (to the fullest extent permitted by applicable law). Notice is considered given upon receipt or 24 hours after sending an email, unless the sender is notified that the email address is invalid. Alternatively, we may provide notice to you by certified mail, postage prepaid and return receipt requested, to any physical address you provided during the registration process or later updated in your account (if applicable). Notice is considered given three (3) days after the date of mailing to a physical address and one day after sending to an electronic address.
Relationship: You acknowledge and agree that these Terms and your use of the services do not create an agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and TelmyVet.
Waiver: If you fail to comply with these Terms and we do not take immediate action, it does not mean that we are waiving or relinquishing any rights we may have (including, but not limited to, taking action in the future).
Severability: If any provision of the Terms is deemed unlawful, void, or unenforceable for any reason, that provision shall be considered separate and shall not affect the validity and enforceability of the remaining provisions.
Assignment: You may not transfer or assign these Terms or any rights, licenses, or privileges granted by these Terms. However, TelmyVet may assign or transfer these Terms without restriction and without notice to you.
Entire Agreement: These Terms, the Privacy Policy, and any other terms and conditions that you agree to constitute the entire and exclusive agreement between TelmyVet and you regarding the services, superseding any prior agreements, whether oral or written, between TelmyVet and you regarding the services.
Interpretation: These Terms are binding upon the parties and their respective successors and permitted assigns. The division of these Terms into paragraphs or sections and the inclusion of headings are for convenience of reference only and do not affect the construction or interpretation of these Terms.
Governing Law: The mobile responsive web application is operated from TelmyVet's offices in the Province of British Columbia, Canada, but can be accessed from jurisdictions with different laws. (Not applicable to residents of Quebec, Canada) Unless the laws of your jurisdiction require that your jurisdiction's laws govern, these Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. Any dispute is to be submitted to a court of comPet/Animalent jurisdiction in the judicial district of Vancouver, Province of British Columbia, Canada. TelmyVet makes no warranty or representation that the content and/or services provided on the web application, or any other referenced materials or services are lawful in other jurisdictions or available for use in all jurisdictions. If you access the web application outside of British Columbia, you are responsible for complying with local laws.

SECTION 2 - ADDITIONAL TERMS FOR PET/ANIMAL OWNERS (TELMYVET):
In addition to being bound by the terms and conditions outlined in Section 1, Pet/Animal Owners using TelmyVet's services must also adhere to the following additional terms and conditions:
PET/ANIMAL OWNER CONSULTATION AND PHARMACY DISPENSING FEES:
When a Pet/Animal Owner books an appointment on TelmyVet, they are directly booking with a veterinarian (referred to as the "applicable veterinary professional"). Similarly, when a Pet/Animal Owner fills a prescription using the online pharmacy service, they are purchasing the prescription directly from the third-party pharmacy provider. TelmyVet acts as a facilitator for these transactions and does not provide medical advice or pharmaceutical services.
Pet/Animal Owners will be charged an appointment fee, as determined by the veterinarian, for the services provided during the appointment. Additionally, a pharmacy dispensing fee may be applied for the provision of pharmaceutical services. Pet/Animal Owners will also be charged a service fee. Upon booking an appointment with a veterinarian via the services, Pet/Animal Owners will also be charged a service fee by TelmyVet (the "Service Fee"). This Service Fee covers technical and customer support, payment processing, platform utilization and maintenance, and other costs incurred by TelmyVet in facilitating the appointment between the Pet/Animal Owner and the veterinarian. It is important to note that the Service Fee is separate from the appointment fee and pharmacy dispensing fee.
All payments are processed through TelmyVet's third-party payment processor, Stripe. Payment information will be processed in accordance with Stripe's End User Terms of Service and Stripe's Privacy Policy (collectively, the "Stripe Agreements"). By agreeing to these Terms or continuing to use TelmyVet's services, you agree to be bound by the Stripe Agreements as they may be modified by Stripe. As a condition of TelmyVet enabling payment processing services through Stripe, you authorize TelmyVet to share accurate and complete information about you and transaction information related to your use of the payment processing services with Stripe.
Pet/Animal Owners are responsible for paying all fees and applicable taxes associated with TelmyVet's services in a timely manner using a valid payment method. If a payment fails or is past due, TelmyVet may employ other collection mechanisms to collect the owed fees, including charging other payment methods on file, retaining collection agencies, and seeking legal counsel.
The currency exchange rate, if applicable, and any transaction fees are determined solely by the bank or agency processing the transaction. These fees may be applied by the card issuer as a charge to the cardholder's account. When applied by the card issuer, the fees will be listed separately from the transaction amount on a credit or debit card statement. This means that the amount shown on your billing statement may differ from the figure displayed on the billing summary page for a consultation booked on the site. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuer for clarification.
PET/ANIMAL OWNER REFUND POLICY (TELMYVET):
Please note that all fees for consultations with veterinarians and TelmyVet's associated Service Fee are generally non-refundable, except in the following circumstances, as determined by TelmyVet in its sole discretion:
Consultation Call Ends in Less Than Three Minutes: If a consultation call ends in less than three minutes, a refund may be issued upon confirmation by TelmyVet.
The Provider Does Not Attend a Scheduled Consultation Call: If a veterinarian fails to attend a scheduled consultation call, a refund may be issued upon confirmation by TelmyVet.
If a Pet/Animal Owner believes they are entitled to a refund based on the above circumstances, they must submit a refund request using the "Contact Us" form on the TelmyVet website. TelmyVet will review the request and, if it falls within the eligible categories, process the refund within five (5) business days. Please note that TelmyVet's decision regarding refunds is final and binding.
For refunds related to prescriptions, Pet/Animal Owners must directly contact TelmyVet's third-party pharmaceutical provider, Pet Meds. Refunds of subscription fees for Subscription Plans will be subject to the terms and conditions specified in each respective Subscription Plan.
Pet/Animal Owners need to review and familiarize themselves with TelmyVet's refund policy and the specific terms and conditions of any Subscription Plan they have subscribed to.
PET/ANIMAL OWNER RESPONSIBILITY FOR PET/ANIMAL INSURANCE (TELMYVET):
Please be aware that TelmyVet does not offer insurance coverage for any virtual veterinary care services, pharmaceutical services, or other services obtained through the TelmyVet platform. It is the sole responsibility of the Pet/Animal Owners to obtain appropriate Pet/Animal insurance coverage to protect their Pet/Animals.
TelmyVet strongly recommends that Pet/Animal Owners consider obtaining Pet/Animal insurance to safeguard against unexpected veterinary expenses and to ensure that their Pet/Animals receive the necessary care. Pet/Animal insurance can provide coverage for various veterinary services, including virtual consultations, medications, diagnostic tests, surgeries, and other treatments.
Pet/Animal Owners should carefully review and select a Pet/Animal insurance provider and policy that best suits their needs and the needs of their Pet/Animals. It is essential to understand the terms, coverage limits, exclusions, and reimbursement processes outlined in the Pet/Animal insurance policy.
By using TelmyVet's services, Pet/Animal Owners acknowledge and agree that they are solely responsible for obtaining and maintaining adequate Pet/Animal insurance coverage for their Pet/Animals. TelmyVet does not assume any responsibility for any costs, damages, or liabilities related to the absence or insufficiency of Pet/Animal insurance coverage.
If Pet/Animal Owners have any questions or require further information regarding Pet/Animal insurance, TelmyVet recommends contacting reputable Pet/Animal insurance providers or consulting with a licensed insurance professional who specializes in Pet/Animal insurance.
SECTION 3 - ADDITIONAL TERMS FOR VETS (TELMYVET):
In addition to the terms and conditions outlined in Section 1, Veterinarians and Registered Veterinary Technicians (Providers) who register on the TelmyVet platform are also subject to the following terms and conditions:
Responsible for Professional Compliance and Compliance with Laws: Providers are solely responsible for ensuring compliance with all applicable laws, rules, ordinances, or regulations related to virtual veterinary care and the practice of veterinary medicine. This includes, but is not limited to, compliance with data and privacy laws, as well as any licensing requirements that apply within their jurisdiction.
Awareness of Virtual Care Limitations: Providers must understand the limitations and restrictions associated with providing teletriage, telehealth, telemedicine, telemonitoring, and online care, particularly in the context of the jurisdiction(s) where they hold their license(s). TelmyVet does not provide interpretation of local legislation or guidance regarding platform usage. It is the Provider’s responsibility to ensure their use of the platform is within the bounds of their licensure. TelmyVet will not be held responsible for any errors or omissions by Providers in this regard.
Use of Personal Information: By using the TelmyVet platform, Providers agree that any personal information obtained from or through the platform will be used solely for purposes directly related to the platform, such as Site-related communications, utilizing services offered, or conducting financial transactions. Providers are prohibited from using such information for any unlawful purposes or intents. Consent must be obtained from the user for any disclosure of their personal information to third parties, except as defined in this provision.
Protection of User Information: Providers are obligated to offer users the opportunity to review and opt-out of having their personal information retained in address books, databases, or other records. Providers are also responsible for safeguarding users' personal information with the same level of care as they would their confidential information. They assume liability for any misuse, loss, or unauthorized transfer of such information.
Prohibition of Spam: The use of TelmyVet to send spam or unsolicited commercial electronic communications is strictly prohibited. Providers may not add TelmyVet users to their mailing lists (email or physical) without the user's explicit consent, except as allowed by law. Violation of this term is considered a breach of these Terms.
Providers should note that these additional terms and conditions are specific to their use of the TelmyVet platform and should be read in conjunction with the general terms and conditions outlined in Section 1.PROVIDER ELIGIBILITY & LISTING PRACTICE REQUIREMENTS
The acceptance of any Provider listing on the TelmyVet platform is subject to the sole discretion of TelmyVet. To be eligible to list your services on the site, you must meet the following requirements:
Valid Veterinary License: You must hold a valid and active veterinary medicine license issued by the veterinary regulatory authority in the state/province/territory where you practice.
Professional Conduct: You should not have any outstanding investigations or complaints of professional negligence or misconduct against you.
Compliance with Legal Statutes: It is your responsibility to ensure that your teletriage, telehealth, telemedicine, and online care services comply with the legal statutes and regulations set forth by the veterinary regulatory authority in your licensed jurisdiction.
Medical, Professional, and Ethical Standards: You must uphold and adhere to all applicable medical, professional, and ethical duties and standards while providing teletriage, telehealth, telemedicine, and online care services through the TelmyVet platform.
Professional Judgement: You are expected to exercise professional judgment to determine the appropriateness of teletriage, telehealth, telemedicine, or online care in each specific circumstance. This includes assessing whether a physical examination is necessary for an accurate diagnosis or prescription of drugs.
Compliance with Veterinary Telehealth Requirements: You are solely responsible for complying with any veterinary teletriage, telehealth, telemedicine, and online care requirements imposed by your veterinary regulatory authority and/or veterinary medical association. This includes ensuring compliance with licensing requirements in the jurisdiction where the Pet/Animal is located and determining whether a veterinary-Pet/Animal Owner relationship (VCPR) is necessary or can be established through a teletriage, telehealth, telemedicine, or online care consultation on the TelmyVet platform.
VCPR Integrity and Confidentiality: You must uphold and maintain the integrity and confidentiality of the veterinary-Pet/Animal Owner relationship (VCPR) established through the TelmyVet platform.
Please note that these requirements are subject to change, and it is your responsibility to stay updated with any modifications or additional requirements set forth by TelmyVet.
LISTING PRACTICE REQUIREMENTS
To post a listing on the TelmyVet platform, Providers must comply with the following requirements set by TelmyVet Inc.
Submission of License and Clinic Information: Veterinarians are required to provide their veterinarian license information and, if applicable, the information of their veterinary clinic, including the name, address, and contact details. This information is necessary to complete the Account setup process. Please note that all veterinarians must hold a valid and active veterinary license in good standing to use the TelmyVet platform.
Timely Response to Booking Requests: Prompt and efficient response times contribute to a positive experience for the Pet/Animal Owners.
Responsiveness to Inquiries and Booking Requests: Providers are expected to respond to and accept a significant number of inquiries and booking requests received through the platform. This requirement aims to ensure active engagement and availability for Pet/Animal Owners seeking veterinary services.
Limitations on Cancellations: Providers are prohibited from canceling a significant number of accepted consultation bookings. This measure is in place to maintain reliability and minimize disruptions in the Pet/Animal Owner experience.
Please be aware that failure to comply with these listing practice requirements may result in the review and potential removal of your listing from the TelmyVet platform. It is important to adhere to these requirements to ensure a high standard of service for Pet/Animal Owners and to maintain a positive professional reputation on the platform.
PROVIDER RESPONSIBILITY FOR PROFESSIONAL LIABILITY INSURANCE
Providers using the TelmyVet platform are responsible for obtaining and maintaining appropriate professional liability insurance coverage. By listing their services on the platform, Providers agree to have or acquire the necessary insurance coverage and to keep it active during their tenure on the site. Upon request, Providers agree to provide TelmyVet with copies of relevant proof of insurance coverage.
TelmyVet acknowledges that it maintains a $5 million Professional Liability insurance policy. This insurance coverage is designed to provide liability protection for all Pet/Animal owner consultations conducted by Vets through the Services, including consultations conducted via phone, videoconference, or other social media platforms.
Having professional liability insurance coverage helps protect both the Providers and the Pet/Animal owners in the event of any unforeseen incidents or claims related to the veterinary services provided. It is important for Vets to maintain adequate insurance coverage to safeguard their practice and provide peace of mind to their Pet/Animal Owners.
Please note that the terms and conditions of the insurance coverage provided by TelmyVet may apply, and Vets should review the specific policy details and any limitations or exclusions that may exist.
PET/ANIMAL OWNER TRANSACTIONS
TelmyVet serves as the merchant of record for all transactions conducted between Providers and Pet/Animal Owners on the platform. As the merchant of record, TelmyVet handles the payment process and is responsible for remitting the payment to the Practice owner, as outlined in Section 2 -
PET/ANIMAL OWNER CONSULTATION AND PHARMACY DISPENSING FEES:
To maintain a streamlined and secure payment process, Providers are prohibited from requesting or accepting payment directly from Pet/Animal Owners in any form or manner for services performed through the TelmyVet platform. This ensures consistency and transparency in the transaction process.
Any violation of this policy, where a Provider requests or permits a Pet/Animal Owner to remit payment directly to the Provider or its representative or agent, may result in the immediate removal of the non-compliant listing from the TelmyVet platform. This action may be taken without prior notice to the Vet.
By adhering to this policy, TelmyVet aims to facilitate a smooth and reliable payment experience for both Vets and Pet/Animal Owners, while maintaining the integrity of the platform and its services.
PAYMENT PROCESSING
TelmyVet utilizes the payment services of Stripe Payments Canada, Ltd for processing payouts to Vets. By agreeing to these Terms or continuing to operate as an Account holder on the TelmyVet platform, you acknowledge and agree to be bound by Stripe Payments Canada, Ltd's terms and conditions, which govern the use of their payment services.
As a condition of using Stripe Payments Canada, Ltd's payment services through TelmyVet, you authorize TelmyVet to share accurate and complete information about you and your business, as well as transaction details related to your use of the payment services, with Stripe Payments Canada, Ltd for the purpose of processing payments and ensuring compliance.
Stripe Payments Canada, Ltd is a trusted and secure payment processing platform that offers reliable and efficient services. Through this partnership, TelmyVet aims to provide a seamless and convenient payment experience, while ensuring the necessary security measures and compliance with applicable regulations.
